Consultation Document on the LPTAA

Under a research service agreement concluded in March 2023 between the Ministère de l'Agriculture, des Pêcheries et de l'Alimentation (MAPAQ) and Université Laval, the DDSA Chair was mandated to draft a consultation document relating to the Loi sur la protection du territoire et des activités agricoles (LPTAA), under the direction of Professor Geneviève Parent.

The report produced by the DDSA Chair, entitled "Protection du territoire et des activités agricoles : LPTAA et mécanismes juridiques innovants," was made public as part of the National Consultation on Agricultural Land and Farming Activities — Acting to Feed the Québec of Tomorrow. This document was intended to inform collective reflection on the future of agricultural land protection in Québec and to support the development of avenues for modernizing the existing legal framework.

Outcome

Support for the Revision of the Loi sur la protection du territoire et des activités agricoles (LPTAA)

As part of the National Consultation on Agricultural Land and Farming Activities — Acting to Feed the Québec of Tomorrow, the DDSA Chair was mandated by MAPAQ to contribute to the reflection surrounding the revision of Québec's LPTAA. This mandate was carried out between April and December 2024.

The support provided by the DDSA Chair aimed to assist the Ministry's legislative counsel through a comparative analysis of legal mechanisms in force in other Canadian provinces (outside Québec) and internationally. The work focused in particular on three themes: agricultural leases; monitoring and oversight of agricultural land transactions; and compensation mechanisms associated with major government projects.
